    Sammanfattning

    International law and EU law that also has international legal origins do have an at least partially separate system of responsibility. The general norms of states' responsibility for internationally wrongful acts are governed by customary international law. The possibility of invoking circumstances precluding wrongfulness as regulated by international law in case of infringing the founding treaties of the EU or obligations arising out of them is in the forefront of this article. Circumstances precluding wrongfulness are special situations that might justify and/or excuse an otherwise internationally wrongful act of a state. The findings of this articles are based on the analysis of relevant CJEU case law as well as secondary sources.
