Sammanfattning

This chapter highlights the importance of administrative frameworks in safeguarding animal welfare and well-being. Finland, as an EU member, must balance animal welfare requirements with for example cultural and regional practices, while also adhering to EU legislation. The Court of Justice of the European Union (CJEU) plays a significant role in interpreting animal protection legislation, advocating for a balance between welfare requirements and other interests, and ensuring that the core purpose of animal protection laws is upheld. The statutes in force, including EU law and the Finnish animal protection legislation, provide comprehensive and effective regulations for administrative measures for the protection of animals. This chapter emphasizes the preventive role of administrative mechanisms, as opposed to reactive legal measures and processes. Strengthening the legal status of animals, possibly through recognizing fundamental animal rights, would improve both animal protection and welfare as well as human legal safeguards against public power.
