Animal law unveiled: defining a new era of legal advocacy

Abstract

This chapter lays the groundwork for recognizing animal law as a distinct legal discipline, defining its unique characteristics and demarcating its boundaries from other areas of law. It emphasizes the importance of understanding the broad scope of animal law, particularly in relation to legal actions undertaken to protect animal interests. Through a historical lens, the paper traces the evolution of animal law, highlighting key developments that have progressively centered animals’ interests alongside those of humans. The closer a legal action aligns with the core principles of animal law, the more it reflects a genuine recognition of animals’ intrinsic rights and interests. Understanding and maintaining a clear scope for animal law is crucial—not only for its functional application but also for shaping the language and philosophy of legal discourse in this emerging field. This perspective is especially vital as we navigate the complexities of legal actions in the Era Novum, a time when the recognition of animal rights stands at a pivotal crossroads.
